DUII Police Interview Tip

I see all too often in police reports that a driver suspected of DUII (driving under the influence of alcohol) gets interviewed by police and answers a question like this:

Officer: On a scale of 0 to 10, with 0 being stone cold sober and 10 being falling down drunk, how do you rate yourself?

Driver: I think I'm a 2.

What that driver has unwittingly done is tell the police, the DA, and the judge and jury that he was feeling the effects of alcohol . That kind of an admission can make all the difference between an acquittal and a conviction for DUII!Moral of the story: It's usually best to insist on your constitutional right to silence.
